1. INTRODUCTION

Welcome to MetalREMS. These Terms and Conditions ("Terms") govern your access to and use of our platform, including our website and messaging services (the "Platform"). By using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our services.

2. ROLE OF THE PLATFORM

MetalREMS provides an online marketplace that facilitates connections between buyers ("Buyers") and sellers ("Sellers") of metal materials and products. MetalREMS is not a party to any transaction between users. We do not sell, buy, or take possession of any materials listed on the Platform.

3. USER RESPONSIBILITIES

As a user of MetalREMS, you agree to:

  • Provide accurate and truthful information in your listings, including material specifications (Grade, Temper, Dimensions) and condition.
  • Maintain the confidentiality of your account credentials.
  • Use the Platform's messaging system solely for legitimate business enquiries and transactions.
  • Comply with all applicable laws and regulations regarding the sale and transport of materials.

4. LISTINGS AND DESCRIPTIONS

Sellers are solely responsible for the content of their listings. While MetalREMS encourages high-quality listings and MTR (Material Test Report) documentation, we do not verify the accuracy, safety, or quality of the materials listed. Buyers are encouraged to perform their own due diligence before completing a purchase.

5. TRANSACTIONS AND PAYMENTS

The final sale of materials occurs directly between the Buyer and Seller. MetalREMS does not process payments for material transactions or handle shipping logistics. All terms of sale, including price, delivery, and payment methods, must be agreed upon directly between the parties involved.

6. FEES AND SUBSCRIPTIONS

MetalREMS may offer subscription plans or listing fees for certain features of the Platform. All fees are non-refundable unless otherwise specified. We reserve the right to modify our fee structure with prior notice to affected users.

7. LIMITATION OF LIABILITY

IN NO EVENT SHALL METALREMS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE PLATFORM OR ANY TRANSACTIONS BETWEEN USERS. OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. METALREMS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. TERMINATION

MetalREMS reserves the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business interests of the Platform.
